These terms cover buying and using EmberSSH. EmberSSH is made by Chase Zeigler ("we", "us"). By buying or using EmberSSH you agree to them.

What you get

One payment and EmberSSH is yours to use on your own computers. Your purchase covers every platform we release EmberSSH for (macOS today; Windows and Linux when they're available) and every future version we release, at no extra cost. There's no subscription, license key or activation, and EmberSSH never checks whether you've paid. We trust you.

A purchase is for one person. If an organization gets EmberSSH for its people, each person who uses it should have their own purchase.

What you can't do

  • Share, sell, rent or redistribute EmberSSH or your download links.
  • Remove or change copyright notices in the app.
  • Reverse engineer EmberSSH, except where the law allows it.
  • Use EmberSSH to access servers or systems you aren't allowed to use, or for anything unlawful.

Updates

We keep improving EmberSSH, and updates may add, change or remove features. We don't promise any particular feature or release date, including dates for new platforms.

Buying

Purchases are processed by Paddle (Paddle.com), our online reseller and merchant of record. Paddle handles payment, sales tax or VAT, invoices and refunds, and its buyer terms apply to the payment itself.

Refunds

If EmberSSH isn't right for you, ask for a refund within 30 days of your purchase and you'll get your money back in full, no questions asked. See Refunds for how.

Your servers and data

You're responsible for the servers you connect to, the commands you run and the files you change. EmberSSH asks before it deletes or overwrites files, but it can't undo changes made on a server. Keep your own backups, including EmberSSH's encrypted backup file.

Your connections, passwords, keys and files stay on your computer. We never receive them, so we can't recover them for you.

Open-source components

EmberSSH includes open-source software, each part under its own terms. The full list comes with the app.

No warranty

EmberSSH is provided "as is". To the extent the law allows, we don't promise it will be free of errors or fit every purpose. This doesn't affect consumer rights you have by law that can't be waived.

Limits on liability

To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost data or lost profits, and our total liability is limited to the amount you paid for EmberSSH. Nothing here limits liability that can't be limited by law.

Claims caused by misuse

If someone makes a claim against us because you used EmberSSH unlawfully or broke these terms, you agree to cover our reasonable costs of dealing with it, including legal fees.

If you break these terms

You can stop using EmberSSH at any time. If you break these terms, your right to use EmberSSH ends and you must stop using it and delete your copies. Everything you stored in EmberSSH stays on your computer; you can export it as an encrypted backup or delete it yourself. Sections that by their nature should continue (such as "No warranty" and "Limits on liability") still apply.

Things outside our control

We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our hosting or payment providers, natural disasters or changes in the law.

If EmberSSH changes hands

We may transfer these terms to someone else as part of a merger, acquisition or reorganization, and your purchase stays valid. You can't transfer your purchase to someone else without our agreement.

The law that applies and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA. Disputes will be handled by the state and federal courts located in Pennsylvania, unless the law where you live gives you the right to bring a claim there. Please contact us first; most problems can be solved by email.

Changes

We may update these terms. The date at the top shows the latest version. Changes don't take away what you've already bought.
